Terms of Service

The contract governing your use of Fuze, including the Data Processing Agreement (DPA) within the meaning of Article 28 GDPR.

1. Purpose

Fuze is a SaaS marketing decision-support tool for professional photographers. Using the service implies unreserved acceptance of these terms. The service is published by TexturingXYZ SARL, a French limited liability company, registered office 71 rue Ampère, 31670 Labège, France — SIRET 819 447 558 00027, Toulouse Trade and Companies Register 819 447 558, VAT FR03819447558. 2. User account

  • You must be at least 16 years old to create an account.
  • You are responsible for keeping your credentials confidential.
  • Any activity carried out from your account is deemed to be yours.

3. Acceptable use

You agree to:

  • Only sync a calendar you have a legitimate professional right to use.
  • Not circumvent technical limits (AI quotas, API calls).
  • Not use the service for illegal activities or activities harming third parties.

4. Intellectual property

You retain full ownership of your data. AI-generated content (briefs, plans, scripts, storyboards) is licensed to you on a non-exclusive, transferable basis for unlimited commercial use.

The Fuze software, its interfaces and its brand remain our exclusive property.

5. AI-generated content — transparency

Recommendations produced by Studio Brain are generated by language models. They are decision support, not binding professional advice. You remain the sole judge of their implementation and of how you communicate them to your clients.

6. Pricing and billing

Current prices are displayed on the Pricing page. Any change is notified to you 30 days before it applies.

7. Termination

You may delete your account at any time from Settings → Account. All your data is then erased within 30 days, unless a legal retention obligation applies.

8. Liability

The service is provided "as is". AI recommendations guarantee no commercial outcome. Our liability is limited to the amounts actually paid over the 12 months preceding the triggering event.

9. Governing law

These terms are governed by French law. Any dispute falls under the competent courts of the publisher's registered office, subject to mandatory consumer-protection provisions.

10. Data Processing Agreement (DPA — Art. 28 GDPR)

This section constitutes a data processing agreement upon acceptance of these Terms. You ("Controller") entrust Fuze ("Processor") with the processing of personal data on the following terms.

10.1 Subject matter — Shoot detection, workload calculation, generation of marketing recommendations from your calendar and catalogue.

10.2 Duration — For as long as your account is active.

10.3 Nature of the data — Calendar events (titles, dates, duration, description, guests), offer catalogue, brand preferences.

10.4 Categories of data subjects — You, your collaborators, and your end clients appearing in synced events.

10.5 Fuze's obligations — Process only on documented instructions; ensure confidentiality by its staff; implement the technical and organisational measures described at /legal/privacy; notify any breach within 48 hours; assist in responding to data-subject requests.

10.6 Sub-processors — General authorisation is granted for the sub-processors listed at /legal/subprocessors. Any change is notified to you 15 days before it applies; you may object.

10.7 End of contract — Deletion or return of all personal data within 30 days of the end of the service, except mandatory legal retention.

10.8 Audit — Once a year you may request the available audit reports (SOC 2, ISO, penetration tests) of our sub-processors.

11. Google services and APIs

Fuze relies on Google APIs (Sign-In, Calendar, Analytics Data, Maps / Places / Geocoding). By connecting your Google account, you authorise Fuze to access the read-only scopes described in section 13 of the privacy policy.

  • Use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
  • Google Calendar access is read-only: Fuze never creates, modifies or deletes any event.
  • Mapping features are subject to the Google Maps Platform Terms of Service.
  • You can revoke access at any time from Settings → Integrations or from myaccount.google.com/permissions. Revocation may disable some Fuze features.
  • Fuze is neither affiliated with nor sponsored by Google. Google may change or discontinue its APIs; we are not responsible for the resulting unavailability.
